Civil Litigation
Attorney Hall is a seasoned civil litigator and will prepare you for litigation - vigorously advocating and protecting your rights - should your case have to go to trial.
For many clients, the thought of going to court is daunting. There are cases in which filing a lawsuit and participating in litigation is the only way to press a full and fair recovery for a client, or to resolve a disputed case. There are several parts to litigation:
1) Filing suit
2) Serving the suit filed on the opposing party
3) The “discovery process”, which entails preparing and serving interrogatories (questions) and request for production of documents on the opposing party, taking depositions of parties and witnesses, sometimes engaging expert witnesses to testify at trial, and filing motions with the court
4) Mediation, which entails a meeting of the parties, with their respective attorneys, and an independent/neutral third party mediator, to attempt to resolve the case before going to trial
5) Trial, which is the plaintiff’s attorney putting on the plaintiffs case before a judge or jury, and proving, usually by a preponderance of the evidence, the plaintiff’s case and seeking damages
